1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years and over who are current HCF/Manchester Unity members and have completed a '90 day challenge'. Employees (and their immediate families) of the Promoter and Manchester Unity and their agencies associated with this promotion are ineligible to enter.
  3. To enter, once the entrant has completed their 90 day challenge, the entrant must write a testimonial (of up to 200 words) explaining their experience during the 90 day challenge and send to wellbeing@hcf.com.au. The email must include the entrant's full name and telephone number.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. Incomplete, indecipherable or illegible entries will be deemed invalid.
  6. Only one (1) entry permitted per person.
  7. This is a game of skill and chance plays no part in determining the winner/s. Each entry will be individually judged based on the literary and inspirational merit of the testimonial submitted. The Promoter's decision is final and no correspondence will be entered into.
  8. The testimonial/s deemed to be the most inspirational by the judges will each be awarded a prize. Nature and number of prizes will be determined by the Promoter in its absolute discretion. Winner/s will be notified by telephone and/or email.
  9. Prize/s, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  10. This promotion will continue until it is terminated by the Promoter in its absolute discretion. The Promotion will give reasonable notice on this website of its intention to terminate.
  11. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  13. Each entrant warrants to the Promoter that their entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.
  14. It is a condition of accepting a prize that the entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display any materials they have submitted via the promotion for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use. Entrants warrant that they have the full authority to grant these rights.
  15. The Promoter will contact the winner/s via telephone and/or email asking if they consent to having their name published alongside their testimonial. If the winner/s do not provide such consent, an anonymous name will accompany their testimonial. If the winner/s do provide consent, the winner/s permit the Promoter using their name in any media for an unlimited period without remuneration for the purpose of promoting this competition, and promoting any products manufactured, distributed and/or supplied by the Promoter and Manchester Unity.
  16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Entries will not be returned to any entrant.
